These Terms of Service ("Terms") govern your access to and use of the website and compliance services provided by Multimodal Compliance Services LLC ("MCS," "we," "us," or "our"), a DOT compliance filing service registered in FMCSA's Motus system as a supporting company of the FMCSA and a BOC-3 blanket company. We provide BOC-3 process agent services and advisory, educational, and administrative compliance support to commercial motor carriers. MCS is a private company; it is not a government agency or subdivision of the FMCSA, and the FMCSA retains all regulatory and enforcement authority. By accessing our website or engaging our services, you agree to these Terms. If you do not agree, do not use our services.
Services & Regulatory Role
MCS provides DOT compliance management services, including BOC-3 process-agent filing, UCR registration, Form 2290 HVUT e-filing, driver qualification file management, drug & alcohol consortium administration, ELD management, safety audit readiness review, FMCSA Clearinghouse management, IFTA/IRP registration, and compliance gap analysis and onboarding. MCS provides BOC-3 process agent services as a supporting company of the FMCSA and BOC-3 blanket company, facilitating the mandatory federal filings our clients require.
Our services are advisory and administrative in nature. We act as an authorized support entity on your behalf; we do not exercise regulatory authority, we are not a guarantor of any regulatory outcome, and our engagement does not alter your independent obligation to comply with applicable federal and state regulations. The specific scope of services you receive is defined in your service agreement and selected service tier.
Your Account & Responsibilities
You must provide accurate, current, and complete information when creating an account or submitting an onboarding manifest, and you must keep that information updated. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
Accuracy of Compliance Information
Our services depend on the accuracy of the DOT, driver, fleet, and operational data you provide. You are responsible for ensuring that information is true and complete. MCS relies on your representations and is not liable for consequences arising from inaccurate, incomplete, or untimely information you supply.
Fees & Payment
Subscription tiers include Operator ($149/mo), Fleet Command ($399/mo), and Enterprise (custom). Fees, billing cycles, and payment terms are set out in your service agreement. You agree to pay all fees when due. We may change our fees upon reasonable advance notice; any change applies only prospectively after your current billing cycle.
Where a service requires a government filing fee or a third-party cost (such as laboratory analysis, ELD hardware, or statutory filing fees), that cost is published and passed through without markup — you never pay more than the regulatory or vendor rate.
Payment Processing
Payments for services and filings are processed through our third-party payment processor. When you initiate a purchase, you will be redirected to the processor's secure checkout to enter billing and payment information. The processor governs its own transaction terms, and any disputes regarding a charge should first be directed to the processor in accordance with its policies, then to MCS.
MCS does not store full card numbers or raw payment credentials. Transaction records (amount, date, product, and processor-issued identifiers) are retained to fulfill your order and maintain compliance records. Paid services and filings are provisioned after the payment processor confirms a successful transaction.
No Legal Advice
MCS provides compliance support services, not legal advice. We are not your attorney, and our services do not create an attorney-client relationship. You should consult qualified legal counsel for legal questions or representation. We do not guarantee any particular audit outcome, regulatory decision, or that no violation will ever occur.
Intellectual Property
This website, our branding, dashboards, reports, and methodologies are the property of MCS. We grant you a limited, non-exclusive license to use deliverables solely for your internal compliance operations. You may not reverse engineer, redistribute, or resell our materials without our written consent.
Confidentiality
Each party will protect the confidential information exchanged during the service engagement using the same care it uses for its own, and will not disclose it except as required by law or as necessary to perform under the service agreement.
Limitation of Liability
To the maximum extent permitted by law, MCS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total aggregate liability for any claim arising from these Terms or the services is limited to the fees you paid us in the twelve months preceding the claim. We do not warrant that the services will prevent all violations or regulatory actions.
Indemnification
You agree to indemnify and hold harmless MCS from claims, damages, and expenses arising out of your inaccurate or incomplete information, your drivers' conduct, or your failure to maintain compliance with applicable regulations.
Termination
Either party may terminate services in accordance with the terms of your service agreement. Upon termination, accrued obligations survive, and we will return or retain your data in accordance with our retention policy and applicable regulatory requirements.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington, for any dispute arising from these Terms or the services.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date. Your continued use of our services after a change constitutes acceptance of the revised Terms.
