BOC-3 Process Agent Filing
A BOC-3 designates a process agent in every state where you operate — the person authorized to receive legal notices on your behalf. MCS files your BOC-3 across all 50 states in a single one-time submission.
Who needs a BOC-3
For-hire motor carriers and private carriers transporting hazardous materials must designate a process agent in every state of operation before operating authority is granted under 49 CFR 366.
Without a valid BOC-3 on file, the FMCSA will not activate your operating authority — your MC number stays pending and you cannot legally operate interstate.
What MCS does
MCS acts as your process agent nationwide — filing the BOC-3 with the FMCSA, maintaining the designation for the life of your authority, and promptly forwarding any served legal documents to you.
Because MCS is already registered across all 50 states, a single filing covers every jurisdiction instead of you having to secure and manage a separate agent in each one.
Pricing & process
Flat $150, one-time, lifetime. Provide your DOT/MC and MCS files the designation with the FMCSA and confirms it on your record.
No renewals — the BOC-3 stays active for as long as your operating authority is active. If your authority is reinstated after revocation, the designation remains in force.
Frequently asked
No. It is a single one-time filing that remains valid for the life of your operating authority — no annual renewal.
You can, but you would need to designate a process agent in every state where you operate. MCS is already registered across all 50 states, so one filing covers everything.
