Form 2290 Heavy Vehicle Use Tax: Who Owes It and Key Deadlines

If you run a heavy truck on public highways, there's a federal tax you can't skip: the Heavy Highway Vehicle Use Tax (HVUT), reported to the IRS on Form 2290. It's due every year, it's tied to the month your truck first hits the road, and without proof of payment you can have trouble registering your truck.

The tax is imposed by 26 U.S.C. 4481, with rules in 26 CFR Part 41. Once your Form 2290 is accepted and the tax is paid (or suspended), the IRS issues a stamped Schedule 1, your proof of payment for registering or renewing your truck.

Who Owes the Heavy Vehicle Use Tax?

You need to file Form 2290 if a highway motor vehicle:

  • Has a taxable gross weight of 55,000 pounds or more, and
  • Is registered, or required to be registered, in your name at the time of its first use on public highways during the tax period.

Taxable gross weight isn't just the empty tractor. It includes the unloaded truck, any trailers customarily used with it, and the heaviest load customarily carried.

Owner-operators and fleets alike need an Employer Identification Number (EIN) to file; a Social Security number isn't accepted.

How Much Is the Tax?

For the full tax period, the tax is based on taxable gross weight:

  • 55,000 pounds: $100
  • 55,001 to 75,000 pounds: $100 plus $22 for each 1,000 pounds (or fraction) over 55,000
  • Over 75,000 pounds: $550, the maximum

Trucks first used after July pay a reduced, partial-period amount based on the month of first use. Logging vehicles qualify for a lower rate.

Suspended vehicles: If you expect a truck to travel 5,000 miles or less on public highways during the period (7,500 miles or less for agricultural vehicles), the tax is suspended. You still have to file Form 2290 to claim the suspension. If the truck goes over the mileage limit, the full tax becomes due.

Key Form 2290 Deadlines

The HVUT tax period runs from July 1 through June 30. The current period is July 1, 2026, through June 30, 2027.

Form 2290 is due by the last day of the month following the month the vehicle is first used on public highways during the period:

First Used in the Period DuringFile and Pay By
JulyAugust 31
AugustSeptember 30
SeptemberOctober 31
OctoberNovember 30
NovemberDecember 31
DecemberJanuary 31
JanuaryLast day of February
FebruaryMarch 31
MarchApril 30
AprilMay 31
MayJune 30
JuneJuly 31

For trucks already on the road in July, that means the annual deadline is August 31. If a due date lands on a weekend or legal holiday, it moves to the next business day.

Two more rules worth knowing: returns reporting and paying tax on 25 or more vehicles must be filed electronically, and if a suspended vehicle goes over its mileage limit, an amended return is due by the last day of the month after the month the limit was exceeded.

What It Costs to Get Form 2290 Wrong

Late or incorrect filings cost money and can keep your truck parked:

  • Late filing penalty. Under 26 U.S.C. 6651, the IRS can charge 4.5% of the unpaid tax per month, for up to five months.
  • Late payment penalty. An additional 0.5% per month of the unpaid tax.
  • Interest on unpaid tax, on top of penalties.
  • Registration problems. States generally require proof of HVUT payment before they'll register a taxable vehicle. No stamped Schedule 1 can mean no plates or renewal, and a truck that can't be legally registered isn't earning.
  • Costly errors. A wrong VIN, the wrong weight category, or the wrong first-use month can lead to IRS notices, amended returns, and a Schedule 1 your state won't accept.

Form 2290 FAQ

Do I need to file Form 2290 if my truck is under 5,000 miles a year?

Yes. If the truck is 55,000 pounds or more, you must still file to claim the suspension, even though no tax is due.

When is Form 2290 due for a truck I just bought?

By the last day of the month after the month you first use it on public highways. For example, a truck first used in October is due by November 30.

What is a stamped Schedule 1?

It's the IRS proof that your HVUT was paid or suspended. States generally require it to register a taxable truck.

Does the MCS fee include the tax?

No. The $499 MCS fee covers our filing service. The heavy vehicle use tax is paid separately to the IRS.
